Terms and Conditions - Truck Pai

For Shippers and Customers

By downloading, installing, and using the Truck Pai mobile application or website (www.truckpai.com), you (the "Shipper" or "User") agree to be bound by the following Terms and Conditions. Please read them carefully.

1. Scope of Service

Truck Pai provides a digital platform (Marketplace) that connects Shippers/Customers with independent Transport Service Providers (TSPs), such as truck owners, drivers, and operators.

• Facilitator Role: Truck Pai acts only as an intermediary. We are NOT a transport company, and we do not provide direct transportation services.
• Independent Contract: The contract for transportation is strictly between the Shipper and the TSP (Driver/Owner). Truck Pai is not a party to this contract.

2. User Obligations & Conduct

• Eligibility: You must be at least 18 years old to use this service.
• Verification: Before loading goods, it is the Shipper’s sole responsibility to verify the Driver’s license, National ID (NID), and Vehicle Registration papers against the details shown on the Platform.
• Prohibited Use: You may not use the platform for any illegal activities, including sending spam or attempting to hack the system.
• Blacklisting: Truck Pai reserves the right to suspend or permanently ban any User for misconduct, fraudulent bookings, or misbehavior towards drivers or our staff.

3. Goods and Safety

• Packing: The User is responsible for the proper packing and securing of all goods/furniture. Truck Pai is not liable for damages resulting from poor packing.
• Prohibited Items: You are strictly prohibited from transporting illegal goods (drugs, weapons, contraband) as per the laws of the People's Republic of Bangladesh. Truck Pai will report any suspicious activity to the relevant authorities.

4. Payment Terms

• Fare Estimates: The fare shown on the app is an estimate. The final fare is concluded through mutual agreement between the Shipper and the Driver.
• Payments: Payments can be made in cash directly to the driver or via digital methods (e.g., bKash) as supported by the platform.
• Non-Refundable: All payments made to the TSP (Driver) are non-refundable once the service is rendered.

5. Cancellation Policy (Special Condition)

To ensure platform reliability, Truck Pai follows a strict cancellation process:

• No Direct Cancellation: Once a trip is confirmed, it cannot be canceled directly through the mobile application.
• Mandatory Helpline Call: To cancel a trip, the Shipper must contact our Customer Care at +880 9613 240 707.
• Cancellation Charges: If a truck reaches the loading point and the trip is then canceled, the Shipper may be liable to pay a cancellation fee as agreed upon with the Driver.

6. Delays and Demurrage

The Shipper is responsible for any delay or demurrage charges if loading or unloading exceeds the agreed time limit, unless the delay is solely caused by the TSP.

7. Limitation of Liability

• No Liability for Losses: Truck Pai is not liable for any loss, damage, theft, or delay of goods during transit. Any claims for damages must be settled directly with the TSP (Driver/Owner).
• No Warranty: The service is provided on an "as is" basis. We do not guarantee the 100% availability or accuracy of the TSP.

8. Dispute Resolution

In the event of a dispute between the Shipper and the TSP, Truck Pai may act as a mediator to help resolve the issue. However, the final resolution and legal responsibility lie with the involved parties. Any legal proceedings shall be governed by the laws of Bangladesh and the jurisdiction of the courts in Dhaka/Bogura.

For Truck Owners, Drivers, and Operators

This document constitutes a legal agreement between Truck Pai and you (the "Owner," "Driver," or "Operator").

1. Nature of the Relationship

• Technological Intermediary: Truck Pai is a technology-based platform. We are NOT a transportation company.
• Independent Contractor: You are an independent service provider (Freelancer) and NOT an employee of Truck Pai.

2. Eligibility and Documentation

You must be at least 18 years of age and provide valid copies of your NID, Driving License, Vehicle Registration, Fitness Certificate, Tax Token, and Route Permit. Providing false information will lead to immediate account termination.

3. Obligations and Goods Safety

• Inspection: You have the right to inspect the goods before loading. Once loaded, the safe delivery is your sole responsibility.
• Loss or Damage: You are personally liable for any loss, theft, or damage to the goods while in your possession.

4. Service Fees and Payments

• Service Fee: You agree to pay a non-refundable Service Fee (Commission) to Truck Pai for using the platform.
• Fare Negotiation: The final fare is concluded through mutual agreement between you and the Customer.

5. Cancellation Policy (Special Mandatory Rule)

• No In-App Cancellation: Once you accept a trip, you cannot cancel it directly through the application.
• Helpline Support: To cancel, you must contact Customer Care at +880 9613 240 707.

6. Prohibited Conduct

Transporting illegal goods (narcotics, firearms, etc.) is strictly prohibited. Professional behavior must be maintained at all times.
